Victim of Scam Nokia N95

I bid, won and paid for Nokia N95 and received plastic toys!!!  I paid through XOOM that represented as part of PayPal --so in the sense I was under the impression that its PayPal secured.  Now that I know how to tell the real from the fakes, I state that there are more fakes than real Nokia N95 listings nowadays. 

What is ebay doing to protect innocent buyers?  I thought they have rules against selling fakes and misrepresentation of actual products.  Whatever they say they are doing -- IT IS NOT ENOUGH!!!  There are so many listings that say don't bid send email first.

All I can say that TODAY, EBAY IS NOT QUITE AS SAFE A PLACE TO SHOP AS IT WAS YESTERDAY!!

Where do I sign for the Class Action Suit?
