Bank Account Format Change

Starting on September 1, 2003, non-U.S. members who attached a Mexican bank account to their PayPal account on or before July 17, 2003 are required to update their PayPal accounts with the new 18-digit bank account number format (known as the "Codigo Cuenta Cliente" or CLABE), in accordance with Central Bank of Mexico regulations. Members who do not make the required changes by September 1, 2003 may be subject to the automatic removal of their bank account number from their PayPal account.


PayPal Surcharging Policy Update

PayPal's No Surcharge Policy has been updated to clarify when surcharging may occur in the United Kingdom. Section V of the Payments (Sending, Receiving, and Withdrawals) Policy describes the conditions under which sellers residing in the UK and listing items for sale on a UK-based website may impose a surcharge (a fee to the buyer for accepting credit card payments).

The conditions are:
Both the buyer and the seller reside in the United Kingdom.
The purchase price is paid in Pounds Sterling.
The surcharge imposed by the seller is no greater than is necessary to recover the receiving fees incurred by the seller.
The seller clearly indicates to the buyer prior to the buyer's submission of a bid or (in non-auction transactions) prior to the completion of the purchase that a surcharge will be incurred, and the amount of the surcharge
PayPal continues to discourage surcharging as it believes it is detrimental to both buyers and sellers. We will continue to evaluate the effects and incidences of surcharging on our community over the coming months and may continue to revise our policies on this issue in the future.

Updated entire User Agreement to reflect site-wide terminology changes: International accounts are now referred to by the country name when possible (e.g. "Canadian Account") and as "Non-U.S. Accounts" when it is not possible. This change was made to clarify for all of our users which specific instructions and terms refer to them. Updated Sections 1.a and 2.a of the Payments (Sending, Receiving, Withdrawing) Policy to clarify that PayPal makes two small deposits for Expanded Use on adding a U.S. bank account, to include further information on changing your default funding method, and to remove the fee associated with bank account transfers in Germany and the Netherlands. PayPal has updated its Acceptable Use Policy to simplify the policy on transactions of adult items. After June 12, 2003, PayPal will no longer process transactions for adult items through the Mature Audiences category on eBay.com. As a result, after June 12, 2003, PayPal will no longer process payments for adult items anywhere on the internet.

PayPal strives to find the right balance between serving our community and minimizing our financial risk. We feel that exiting the Mature Audiences category with a clear and consistent policy for all adult items best achieves this balance.

As part of this effort, we are extending the deadline for when PayPal customers must stop sending and receiving payments for tangible adult products, including magazines, DVDs and videocassettes. Originally May 12, 2003, this deadline has now been extended to June 12, 2003 to correspond with the phase-out of PayPal service for these items on eBay. The deadline to stop sending and receiving payments for digital adult products and services, including online photos, streaming video and audio services, will remain May 12, 2003. PayPal has added an Acceptable Use Policy to the User Agreement to further clarify items which may be sold using PayPal, and items which may be sold or advertised on websites listed in the PayPal Shops directory. PayPal customers are ultimately responsible for making sure that the transactions they enter into using PayPal are legal. While the Acceptable Use Policy is primarily a clarification of existing PayPal policies, in our attempt to find the right balance between serving the needs of our diverse customer base while at the same time minimizing our financial risks, it was necessary to introduce some additional limitations on the use of PayPal. The Acceptable Use Policy will replace the PayPal Shops Allowable Goods and Services Guidebook.

The Acceptable Use Policy below will take immediate effect for all accounts who sign up on or after March 13, 2003. All accounts who signed up prior to March 13, 2003 will have 60 days to comply with any new terms and conditions in the Acceptable Use Policy below. These accounts must continue to abide by the previous terms of the PayPal User Agreement and associated Policies during the 120-day grace period. As always, there will be no grace period for compliance with regard to any activity that is believed to be illegal.

The monthly withdrawal limit is removed once a member becomes International-Verified by successfully completing his PayPal Membership.

Re-organize the information into a User Agreement that sets out the basic legal relationship between you and PayPal, and various Policies that set the rules for how the PayPal service works. This reorganization is intended to help you more easily understand your legal rights and obligations and to help you find answers to your questions on our various services more quickly.
Update our arbitration clause in order to clarify your dispute resolution alternatives in the event that you have a dispute that cannot be resolved through normal customer service channels.
All PayPal accounts signing up on or after February 7, 2003 will be bound by the new User Agreement immediately. PayPal accounts who signed up prior to February 7, 2003, will have 120 days after the date they next log in to their PayPal account to decide whether they agree to the new User Agreement. These accounts will continue to be governed by the old User Agreement until they agree to the new User Agreement, or until June 4, 2003, whichever comes first. If a customer does not agree to the new User Agreement within the 120-day period, PayPal will assume that the customer does not accept PayPal's User Agreement and prefers not to do business with PayPal. In such circumstances, after providing additional notice to the customer, PayPal will close the customer's account and pay out any existing balance under the terms of the old User Agreement.
