Do you have a place to go now, if things get very bad?
1. You can go live on the Mining Property all year, if you are mining on it.
Remember this land is the Public Land. Did you know that the Government is selling into private hands thousand, yes 1,000s of acres of this Public Land each year!
2. Don't have a small brain and only get one property, you will find out that if you get several 160 acres, you will have more opportunity to get the best spot for you, or give one to a friend. Remember, you can have 10 Mining Properties and still pay Bureau of Land Management (BLM) $5.00 per year for each of the 10 Mining Properties. You will find out more about the minerals on the Property if you go to the Larger Libraries where you can find out about the minerals on the land and in the area.
3. Don't be NEGATIVE, like some people. When you do your research, and find the Mining Property you want, when you go out with your family or friends on the Mining Property to explore some of the things you read about, you will know that it may be the Greatest thing you ever done!
4. Don't be afraid to buy one or two in the right area. When a friend, about 30 years ago said to me, would I sell him one, I said no, I said I will show him how to obtain one. Then he asked about a year later, I said yes. Sense then I have sold over 500 Mining Properties. I have had many, many people write or tell me, that they really really appreciate me selling the Mining Property to them. Now they can have a place to go, a place to call there own and not pay Government Camping Fees, etc.
Yes, we have Mining Properties in Siskiyou County, Nevada County, San Luis Obispo County, Kern County, San Bernardino County, Orange County, San Diego County.
5. Yes, Congress is talking about and submitted bills to let Mining Claim Property owners buy, purchase the Mining Properties.
Yes, than it will be your private property. Will it be at the cost of $2.50 per acre, as stated under the Mineral Patent Laws?
6. The intelligent ones say Knowledge is Power, and the more knowledge you have on Mining Properties, the better! Go to any large Law Library and find the following books; Information on Mining Properties can be found in the United States Code Annotated Title 30; Mining law from Location to Patent by Terry S. Maley; The American Law of Mining by The Rock Mountain Mineral Law Foundation, "the best".
7. The United States Supreme Court case of Wilbur v. U.S. ex rel. Krushnic, 280 US 306 (1930). The Supreme Court said; When the location of a mining claim is perfected under the law, it has the effect of a grant by the United States of the right of present and exclusive possession. The claim is property in the fullest sense of that term; and may be sold, transferred, mortgaged, and inherited without infringing any right or title of the United States.
The TWO MOST IMPORTANT ITEMs to check on before
Obtaining Mining Property:
A. Is the land open? Check the:
"Master Tile Plate".
B. Is there any other Active Mining Claims, before your Location Date in that Section, Quarter Section?
Check the:
"Mining Claim Geographic Report"
C. Both, can be found on the "LR2000" report.
Send for the "Mining Claim Geographic Report"
CAMC # in Question?
Remember, BLM does not always list all the Claims in that Section, on the "Mining Claim Geographic Report".
So it is best to call BLM and ask for all the Active Mining Claims, in that Section. In Califoria, the # is 1-916-978-4400

Private Land versus Public Land Mineral Rights

Some have asked this questions, but they really don't understand what it means.
May I provide some information that might help you understand: <p>
1. In regard to “Public Land Mineral Rights”. The ownership of the "“Public Land Mineral Rights" provides much protection under the Federal and State Laws. The United States Supreme Court in 1930, said in regard to Public Land Mineral Rights. The land or property is "a grant by the United States of the right of present exclusive possession." that "The claim is property in the fullest sense of that term;" you are the owner, and the property or land "may be sold, transferred, mortgaged, and inherited." "and is real property", "The owner is not required to purchase the claim or secure patent from the United States; but so long as he complies with the mining law, his possessory right, for all practical purposes of ownership, is as good as though secured by patent...."<p>
2. In regard to Public Land Mineral Rights, it is true that the government has what is called Fee Title in that Land or Property, and that is good, because it gives you protection. Remember this is Public Land or Property and if you are the Public, and you are, your ownership of this land or property is guaranteed by the Constitution of the United States and the 1872 General Mining Laws, but also the laws set out in these books. Location and Patenting of Mining Claims and Mill Sites in California (about $15.00 from The U.S. Department of the Interior Bureau of Land Management). Or the United States Code Annotated Title 30; Mining Law from Location to Patent; also Mineral Title Examination; by Terry S. Maley; The American Law of Mining by The Rock Mountain Mineral Law Foundation (best), etc.. Federal Registrar, and more! Remember some of these lands, properties in the past have bought, sold for millions of dollars!<p>
3. For example, if you are the owner of what is called, “Private Land” the government might determine that the area has a fire danger, or; so they will send you, usually a “Weed Abatement Notice”, to clear all brush that may become a fire danger, if this is not done, the government well send out personnel to clear all brush, this usually takes several thousand dollars that is billed to the owner of property , if the owner does not clear the brush or, The owner of the Land may not even know about this, until they receive a bill of several thousand dollars to pay by a certain date. If the owner of the land does not pay, then usually a lien will be filed, then the government will take the land away from the owner, and sometimes if they determined this does not cover the cost, the government will go after the owner(s) for the rest of the money. If you own the Mineral Rights only, you are Not Responsible for this and the government is Responsible and has to do it. This will save you thousands of dollars.<p>

A other example is, if you own the “ Private Land” the government may have a water system installed in the area, or electrical lines, underground or above, or gas system, or phone system, etc. This is usually done by obtaining “Bonds” to pay for the water, electrical, gas, phone systems etc. The owner of the Land may not even know about this, until they receive a bill of several thousand dollars to pay by a certain date. If the owner of the land does not pay, then usually a lien will be filed, then the government will take the land away from the owner, and sometimes if this does not cover the cost, the government may determined to go after the owners for the rest of the money. If you own the Mineral Rights only, you are Not Responsible for this and the government is Responsible and has to do it. This will save you thousands of dollars. <p>

6. In regard to “Trespass” if any individual trespasses on "Private Land" and says he got hurt, or someone got killed, they can sue the landowner for millions of dollars. Not with Mineral Land, they first have to file suit against the government, to get permission to sue the government, then they have to sue the government again. There are many, many, many other examples that the protection by the government gives for Mineral Lands. And there are many many many examples of the Liabilities on Private Lands. It is true that on Mineral Land you can live all year long on it as long as you are mining on it.
7. It is true on Mineral Land you can build commercial buildings for the mining operation also residential buildings. It is true on Mineral Land you can do anything you want as long as it is legal and related to mining.
8. It is true on Mineral Land you have protection by the Federal and State laws. This is some of the reasons why we suggest when the Patenting Laws become available again, that individuals only Patent small parts or alone the Highway and not the whole acreage. I hope this information helps you
