How to copyright your Songs, Lyrics, Guitar, Bass, etc

As a recording artist, you made a smart choice by finding out how to copyright, retaining the ownership of your songs and keeping your music safe.  The word copyright is commonly miss-spelled as ‘copywrite’.  So, just to clear things up – copyright is the correct spelling.

It is important to understand that you don’t necessarily have to register your copyright with the United States Copyright Office to have a valid copyright.  The Copyright Act states that you have a valid copyright when your song or sound recordings are "fixed in a tangible medium of expression".   This means that your song must be written down or recorded. All you need to do to establish a legal copyright is affix a copyright notice on your recording or lyrics. The term "affix" simply means you write your name and the year the song was written next to the copyright symbol.
The format looks like this: © YOUR NAME 2007
Note: with Microsoft Word, when you put the letter c in parentheses (  c  ) without spaces, it is displayed as © the copyright symbol. You can also click on Insert at the top of your word processor, then click on symbol and choose the © symbol.

However,  officially registering your song(s) with the Copyright Office has these advantages:
a. the establishment of a public record and evidence of your claim as the valid copyright owner of your songs and sound recordings.
b. The ability to file a federal lawsuit against someone who uses your song or sound recording without your permission.
c.    Eligibility to receive statutory damages and attorneys' fees in the event you file and win a copyright infringement lawsuit.

To register your song(s) you must provide the Copyright Office with the following 3 things:
1. A completed application of proper forms.
2. A deposit of your song or sound recording
3. The filing fee which is $45 as of July 1, 2006.

The smart thing to do to avoid paying a $45 fee for every song is to register a collection of songs together – then you will pay only one $45 fee for all of your songs.
Copyrights for sound recordings are filed on formSR. You can register lyrics by themselves using formPA, but if you are like most musicians and have both lyrics AND music on a recording, you can register the recordings together on formSR. All forms can be downloaded from the Copyright website: copyright.gov/forms
Detailed instructions are included on the forms. 
You will need Adobe Acrobat Reader 7.0 to view the forms. You can get Adobe Acrobat Reader FREE at adobe.com..

The sound recording needs to be on a type of phonorecord: CD, cassette tape, LP or disk, and other formats.
