Beware! Be SURE to follow up with a timely "CLAIM" after a dispute with PayPal! PayPal is NOT as FAIR & SAFE as YOU MAY THINK!
This was an actual buying experience/loss I personally had with ebay and PayPal...
I paid for a Singer 237 sewing machine back in December. I asked the seller several questions about the performance of the machine. He, James Hoover 39fordbetty, gave me nothing but glory regarding the faulty piece. So, I bid, won & paid. The machine stitched so FAST at a tap of the peddle that it was literally frightening! Then to add to it, the peddle also became blazing hot. I couldn't possibly sew a straight seam without hand cranking, which is what the seller suggested I did after later contact. But I had jeans and skirts to make, I couldn't possibly hand crank all of that. I told him what my needs were before buying. I was very upset.....so:
* I filed an "Item not as described" dispute....
*39fordbetty agreed to 2 options IN WRITING on PAYPAL: 1. A partial refund & I keep the super fast, crazy machine. 2. A purchase price refund only if I returned it. The shipping was $19.00, so I would lose $38.00 either way.
*I never escalated the dispute to a "claim" because the seller put this in writing on PayPal! (Thought that would serve as protection enough, looked legally binding enough to me)...SO I THOUGHT
At any rate, I my vehicle broke down. Therefore, I was never able to return the heavy machine to the post office (without losing additional cab fees to and forth $38 + cab fees, couldn't see it). I expected PayPal to stand behind me on this one, because Mr. Hoover-the crank seller wrote in writing that if I hadn't retuned the machine I would get the partial amount of $28.00.
I emailed the seller asking for the amount he promised if I decided to keep the machine. Do you know what he told me? "GET A LIFE" on the email reply. (WHAT TYPE OF PERSON DID I BUY FROM???) So, of course, I immediately called PayPal.
*PayPal told me, after reading the written documentation from the seller back to me, that EVENTHOUGH the seller AGREED IN WRITING that he would partially refund, that since I hadn't escalated to a "CLAIM" they COULD DO NOTHING! I was infuriated! Here it is IN WRITING, yet they could do nothing! Then PayPal had the AUDACITY to suggest that since it was within 90 days that I should return the machine with tracking and IF the seller (who told me to "Get A Life") agreed that it was returned in the same condition as sent that they would get the refund. C'MON! How could I trust a seller who replies with "Get A Life"?? And HOW could I even trust PayPal and their weak excuses? All I could imagine over & over is me sending back the machine, and PayPal giving me that same lame excuse that they "can't do anything" and me losing $120+. Why risk it totally? I just inhaled deeply & suffered the loss. I don't think I can honestly re-sell this faulty item & fully re-coup. I REFUSE to stoop to "Dishonest Seller" level!
SOME PAYER PROTECTION!! I could've done better with Judge Mathis!
Buying with PayPal isn't as SAFE & FAIR as you think!
