False Accusations and Restitution

It has come to my attention recently, that while following EBay Guidelines, and other guidelines, here.  I was falsely accused, of selling an item.  Documented actually as a copy of an item.  I used to be a Software Beta tester, for many years, with Microsoft.  After finishing the test, I would send in my findings, and return my software.  I became a techie after that.  I worked on the machines for a period of time.  Now, I am away from all that, and still hounded by people because, they do not win bids on some items.  I like so many other sellers, are accused of selling forgeries, copies, and what nots.  Becareful on who you accuse of doing something, because the Privacy Act, does not cover you, if you falsely accuse someone of a felonious act.  It may come back and bite you and Ebay.  If you falsely accuse someone of selling a forged item, and they come back and prove it is not a forged item, they may ask for restitution from EBay and you, so be very careful on whom you accuse, unless you have absolute proof!  Business Law, is cut and defined, and so is the court system.    If the accused brings in the item into court and show it is not forged, it is the real deal, and your attorney finds you did this out of spite, or to get back at someone becuase you didnt win a bid.  And you loose your court case.  You could be looking at jail time, restitution of funds, slander (you attempted to slander someones name), and the worst yet : repayment to the individual on his court costs, attorney fees, and loss of wages, he or she might have earned while loosing business on E-Bay.  Not too mention, Ebay could use the information there, to return to you as well, for the same thing, and you will pay the attorneys for EBay, their loss of profit from a would be seller, court costs, and any restitution that the court decides you will pay there as well. 

The bad thing about, all this.  You may go bankrupt in the process, but the other people, will still get their monies from you.  The new brankruptsy laws, prevent you from filing from a lawsuit in which you are to pay, and you have no means of doing so.  So in the long run, becareful on who you point a finger at, and accuse falsely.  We all agreed to the same buyer agreement here.  And we try and follow all the E-Bay guidelines, when selling. 

However, there are a few scam artists on ebay.  Unfortunately, for us.  I have kept my wife away from a few who demanded money be sent by wireless transfer to a western union drop site, only to never be able to get her product.

I myself have been falsely accused recently of something as well.  Instead of offering the item, I agreed with E-Bay, I let them take the listing down.  And in the process notified Dell Computers of a piece of software, I had to reload on any of the Dell Computers.  Dell stated it was mine to do with as I please.  I cut it up into 4 pieces and tossed it into the plastic recyclable barrel at work.  Problem solved.  For me, it was cut and dried.

So, please, people, remember to use some common sense, when accussing anyone of anything, just because you didn't win a bid, there are plenty of items on ebay.  Let's use some common sense, and remember what God said:  Revenge is mine, do not take revenge on yourselves, because repayment is 10-fold.
