When filing a damage claim there are several requirements that must be met or the shipping company will never pay on the claim. This guide should help you get your ducks in a row and provide you with a fighting chance when going against the freight carrier.

In the event your shipment is damaged or items are lost, be sure to make note of it on the delivery receipt before signing and giving to the driver. Who ever sets up the freight shipment should make sure to inform the party at destination of this very important factor. Not everyone knows this procedure and what a difference it can make without it. The carriers require the claim to be filed within 15 days of delivery.

For internal damage not apparent until the package has been opened you have 5 days from the delivery date to file a claim with the freight carrier and you must provide proof that the damage occurred while in transit.  I recommend opening your shipment and checking for damage as soon as it arrives. Do this while the driver is still present and be sure to make note of it on the delivery receipt before signing and giving back to the driver.

If you purchased freight insurance for your shipment through a third party, they will assist you in filing your insurance claim. You must still file with the carrier or logistics company, as required by law. After you have submitted your claim to the carrier or logistics company, you will need to submit your claim to the insurance underwriter for processing.

When submitting a damage or loss claim, you will need the name of the person who set up shipment, Bill Of Lading #, the damage or loss amount, details of damage or loss, and the delivery receipt. The standard claim processing time is 30-120 business days (1-4 months). The carrier must acknowledge your claim in writing within 30 days of receipt of claim and has up to 120 days to completely process.
