Question:  Is selling a gift card to someone else legal?

Answer:  In most cases, yes. Gift cards are meant to be transferred from one person to another; hence their name of "gift" card. There are at least two exceptions to this however: 1.Gift cards may not legally be sold for more than face value; and 2. Some retailers forbid the sale of gift cards.  A gift card will rarely sell for more than face value, so this is not usually a problem.  In practice, the sale of non-saleable gift cards is rarely if ever a problem either.  Retailers have no way to track which gift cards have been bought and sold and which have been given as gifts.  So, while we at GiftCardBazaar.com have never heard of a gift card being invalidated due to a sale, you should always use your best judgment before buying any gift card online.  Don't be afraid to ask the seller if there are any resale restrictions.  These restrictions, if any, will most often be printed on the back of the card.
