eBay seller allaspectsamusementsllc (All Aspects Amusements LLC) sold me an Adams Family pinball machine ( item 140057974148 ) through an eBay auction, on December 4, 2006 for $2,800. Payment was made the next day via check, which was promptly cashed.
At First, they sounded like I would get my machine before Christmas and Allen even told me to come pick it up on Sat 12/16/2006 and that he was always there on weekends. I drove 2 1/2 hours and made it there during what he told me was his normal business hours. The place was locked up and neighboring businesses told me he was there a couple of hours ago. I waited 1 hour and had to drive home. He wasted 5 1/2 hours of my time when he committed to me picking up the machine.
After repeated unanswered, or returned calls, he finally told me there was a problem with the machine and they were going to take care of it and he would make my lost time up to me, don't worry about it.
They made excuses about a "bad optoisolator". I told them I'm an Electrical Engineer and there are multiple sources for all varieties of optos. After months of the opto excuse, they told me it's now a bad board and they sent that machine back to where they got it and have another machine coming in next week from a reliable source to give me.
Huh? Their auctions state that they recondition machines. A bad board and they can't replace it?
To Date (Oct 14, 2007 - 6 weeks shy of a YEAR) and I still don't have my machine. Auction stated "Great present for the holidays". Good thing it was not a gift for anyone.
I had made hundreds calls to them and only received a handful of calls answered or ever returned. I even tried calling from 4 different numbers, hoping they might answer if they were trying to avoid talking to me.
When his voicemail was full, which happened a few times, you would get a message "the Nextel subscriber you are trying to reach Allen Don't_remember_last_name mail box is full" His toll free number forwards to a Nextel cell phone. Isn't the purpose of a cell phone to not miss calls? How many people do you know of that have cell phones, never carry them with them? So how is it, that so many people call and leave messages and the phone is rarely answered?
What you will see in the complaints by others (links below) and in All Aspects eBay feedback is that like my case, they promptly answered the calls before I bought the item and received my check. But after that, they had my number and ignored most calls. In the rare occasions that the phone was answered the response was "no one is here" or "I don't know anything about it" and "I will have someone call you back" which in most cases never happened.
I filled a complaint with NJ Attorney General and requested criminal charges be filled.
They forwarded it to the Middlesex County Consumer Affairs who told me they have a long history with this company and have many open cases. They told me they are in touch with police about my case.
I gave them my call logs showing calls made from just one of my phone numbers, and told them to audit his phone records and they will see virtually NO returned calls, despite the vendors statement in auction "Please contact us at phone number 1-877-ebay-507 from prompt answer". It's a far stretch of the imagination to call not returning hundreds of calls "prompt answer".
Other fraud statement in the auction: "Everything is in working condition and is reconditioned ... Lights ... Mechanics .. Motors .. Everything !!! ... Hours of Fun Soon to follow !!!"
Yes it's been hours of fun all right, but the real enjoyment will begin when his prison sentence starts. If everything was in working condition I would have had the item back in December 2006.
One thing that did not seem to work was that I opened an eBay dispute on this item. The vendor never replied, while still posting new auctions and giving feedback to other buyers. Ebay closed the dispute after 3 months of no response from this vendor. I would think that ignoring a dispute is clear evidence of a shady operation. I never had a chance to post a negative review on the item because he kept making excuses and promises that he never kept and bought enough time that I could no longer leave feedback. It was always "next week" or "sometime soon".
On statement that I read, from an outside site (see ocsportscompany below), said that when he posted a negative feedback against allaspectsamusementsllc, they threatened to not give him his item unless he did a retraction. Maybe you were wondering why there are so many "mutual withdraws" of negative feedback. If this is true, I believe that alone shows a lot about this company.
It now appears that All Aspects Amusements' victims are fighting back and beginning to organize against this vendor to help prevent others from falling victim.
See: Other Guides on this vendor
Also see the mounting negative feedback on allaspectsamusementsllc
One of the feedbacks by ocsportscompany has a site that is organizing against this vendor. eBay does not allow links to outside sites posted in the Guide.
Check this out:
Per the other two guides above, they dealt with a vendor Testedandposted and this vendor (no longer an ebay member) was actually allaspectsamusementsllc. But WAIT ! Is that two positive feedbacks I see for Testedandposted from allaspectsamusementsllc ???
I see "Hope to deal with you again. Thank you." and "Great communication. A pleasure to do business with.". Well I guess so if you are the same person. Maybe there is some truth to the suspicions stated in that off-ebay site (see allaspectsamusementsllc feedback and look for ocsportscompany) that thinks that this vendor has many accounts and gives himself positive feedback to look good.
Hey ... There is even reciprocal Positive Feedback !! Testedandposted left positive feedback for allaspectsamusementsllc
Isn't it against eBay policy to have many accounts and give yourself feedback?
Is that how allaspectsamusementsllc became a powerseller?
Do you know what happens when you corner a rat?
Expect retaliatory negative feedback and imaginary claims if you post negative feedback on this company:
Take a look at the negative feedback allaspectsamusementsllc left for me hours after I bought three of his low priced items ($3 & $4) and left negative feedback regarding this pinball machine. He says "dont sell to this ebayer.. will not pay.. make false statements.. & sabotage you" and "NEVER PAID FOR ITEM.. LEFT NEGATIVE.. steer clear.. SHOULD BE KICKED OFF OF EBAY". Never paid ??? In a couple of hours he decided I was not going to give him the $13. He has cost me a lot more than that. Just because he is a crook does not mean that I, or any of his other victims are crooks. His (retaliatory) feedback post is NOT TRUE. He was paid $2,800 for the machine and I have the cancelled check to prove it.
Evidence of False and Misleading Feedback ?
If you again look at their feedback you will see a negative post by jvegas101 on May-18-07 13:46, and you will then see allaspectsamusementsllc response "all aspects ships over 1 hundred items a month needed a part shiping this week". Then you will see another negative feedback from jvegas101 on Oct-12-07 04:18 and allaspectsamusementsllc reply "making false accusations to hurt our company .. this shows the cracks in ebay", yet he claimed months earlier he was shipping it out that week. He even insults this person by calling him "dead beat" yet by his own response in May acknowledged that jvegas101 paid for the item. But what didn't he say? How about something like "that item was shipped to you" This makes it very clear that he never delivered the item. So what do you call allaspectsamusementsllc statement 5 months earlier "shiping this week" if the item was not delivered in 5 months ?
Isn't it funny how most of allaspectsamusementsllc replies to negative feedback are to the effect of "he never paid" and then he also leaves retaliatory feedback stating that they never paid? This vendor fails to realize, that it is easily proven that the item was paid for and that his remarks are false. Could the purpose of this feedback be to mislead and deceive other eBayers? It's also easily proven by the lack of a signed receipt from a customer or delivery service that the item was never shipped. Yet, per this vendor, everyone who never got their item and leaves negative feedback is a crook and out to harm them, are deadbeats and so on.
Related eBay Policy
Per Seller Non-Performance Policy
"Sellers are expected to consistently perform in a manner that results in a high level of buyer satisfaction. If a seller’s interactions with buyers result in greater than a 5% level of buyer dissatisfaction, as evidenced by negative/neutral feedback and/or Item Not Received complaints received over the recent 90-day period, the seller is in violation of the Seller Non-Performance policy. Please note that although we are not including Detailed Seller Ratings at this time, we will be using them in the future."
"When a seller lists an item on eBay, and a buyer bids for and wins that item, the seller and buyer have entered into a contract that both members are expected to honor. If the seller doesn't live up to this agreement, it leads to a bad buyer experience and may result in negative or neutral feedback for the seller. "
"Violations of this policy by a seller may result in a range of actions, including: Loss of PowerSeller status, Limits on account privileges and Account suspension."
Well if you look at the recent feedback on this seller, it's clear there are a lot of buyers who did not get their goods. And, in the auction I was in, the seller specifically stated "Great present for the holidays" implying that you would have the item by Dec 25 (auction ended Dec 4, 2006). The seller also stated "Everything is in working condition and is reconditioned ... Lights ... Mechanics .. Motors .. Everything !!! ... Hours of Fun Soon to follow !!!". Both of these statements are false and the vendor has breached the agreement we had, despite being promptly paid his $2,800. If not delivering on a sale within almost a year, when it was clearly stated that I would have this for the "holidays" does not fall within this policy, then I guess I'm clueless.
How many of the other machines that he did not deliver on, stating he is waiting for parts, did he state "Everything is in working condition and is reconditioned " ?
Per Feedback Manipulation
"Feedback left or received where the feedback’s primary value is to artificially enhance a member’s reputation rather than provide commentary on genuine transactional experience is not permitted."
"Violations of this policy may result in a range of actions, including: Loss of PowerSeller status, Limits on account privileges, Account suspension and Feedback removal."
Isn't that the purpose of allaspectsamusementsllc retaliatory feedback, which has already been shown to be false, on negative feedbacks given to him to try to diffuse the source of the problem and place blame elsewhere and to make it look like he is the innocent party who does his best and is unfairly attacked?
Doesn't having multiple eBay accounts and leaving reciprocal feedback also violate this same policy?
Per Becoming a PowerSeller
"When buyers see the power seller icon next to a seller's User ID, they know they're working with a seller who ranks among the most successful sellers in terms of product sales and customer satisfaction on eBay."
"To qualify for the PowerSeller program, sellers must consistently sell a significant volume of items, maintain a 98% positive feedback rating and provide a high level of service to their buyers."
Is ignoring most of the hundreds of calls I made to them "a high level of service to their buyers" ?
How about ignoring the dispute that I filled back in December 2006 (through eBays dispute system) regarding not getting this item? How about him ignoring the dispute for 3 months until it was automatically closed by eBay? Is that considered "a high level of service to their buyers" ?
How about in the case of jvegas101 (shown above) and All Aspects commitment of "shiping this week" and then not shipping the item in 5 months? Is that "a high level of service to their buyers" ?
How about the slanderous retaliatory feedback allaspectsamusementsllc left for their customers who are feed up with being ignored and not getting their product? Is that "a high level of service to their buyers" ?
Maybe my expectations of getting a product when it's committed to is simply flawed and unrealistic. It's only coming up on 1 year soon. Maybe "a high level of service to their buyers" means as long as you get it sometime before you die.
Per Power Seller Criteria
"To remain PowerSellers, members must: Uphold eBay community values, including honesty, timeliness, and mutual respect"
Honesty?
As is making a commitment and keeping it?
Like as in: vegas101 (shown above) "shiping this week" and not shipping the item in 5 months?
As in all the empty promises made to me over the last year?
Timeliness?
Hmm, remember the dispute I opened in December 2006 that was never resolved? It's only been almost a year now.
Mutual respect?
Like those retaliatory feedback left for their customers?
